The fact they have covered their bases by claiming UC is irrelevant if your decision to end HB based on the level of care provided was flawed.
If UC cancel back because the tenancies have always qualified as supported accommodation, then of course there will be an overpayment. Just as there will be an underpayment of HB because of the arrears owed – but im not sure thats relevant to the appeals you are dealing with.
The customers didnt claim UC because they believed their tenancies no longer satisfied HB, they claimed to cover their backs/safeguard their tenancies because HB had been cancelled and they needed help with meeting their rent costs.
