Hi There – I had a case exactly like this a few years ago. Amanda from Leeds (a regular boffin poster on hbinfo) sent me an excellent argument and case-law refs as to why the tenancy attaches to the whole property and hence BOTH owners. Using her arguments I won the case at Tribunal. (claimant had one child with the joint owner of the property. The father owned it jointly with his mother and the tenancy agreement was just with the mother.
