I assume you are in England as the qualifying criteria are different in Scotland, Northern Ioreland and (i think) Wales
its usually the person with parental responsibility, so parent or guardian , whose circumstances dictate whether the child can get FSM.
So if the original parent/guardiamn died, then the child is living with someone else who has that responsibility now.
If you have no live claim, its unlikley that the guardian they are living with now wiith now will be receiving any of the qualifying benefits/havbe an income low enough to qualify, but you can ask for a new claim.
I cant see there is any bereavement protection – probably because the parental responsibility will move to another person if the original parent/guardian dies.
