I agree with Peter. I often encounter ideas that a CPS cannot apply if there has been a period of no liability/an extended period of temp absence etc. but it is much more straight forward – at the point of deciding any non-qualifying period, account should be taken (and HB paid) for any subsequent periods where there is an entitlement and ongoing where that still exists.
