The explanatory memorandum to the 2009 amendments suggests that working HB and CTB were out of step with all other income-related benefits, including presumably pension age HB and CTB. Reading that alongside the original wording of para 6 in the legislation.gov.uk version of the HB(SPC) Regs I think you can deduce with reasonable certainty that it has always been “and”. How the HB(SPC) Regs on here and apparently somewhere else came to include the now-amended original working age text I guess we will never know, but I think we can safely conclude that it’s not the right version.
