the 13 weeks absence can be for any reason, they still have a liability to pay rent there.
If they end up claiming somewhwere else, its a bit trickier
Ive had a couple of cases similar to this – where the rent was due at the original property but the customer was in temp accommodation ( in our case, the property was having a wet room installed and building work done – the family had 2 disabled kids so it wasnt really suitable for them to stay there during the work)
HB was paid on the actual temp accommodation – and we did a DHP for the original property to cover the rent while the building work was done/they were absent.
In our case though, there was no legal barr to them being in the original property , it just wasnt safe for the kids to be there.
