I have a similar case at the moment where the landlord has massively increased the eligible communal heating/lighting charges in line with what they say is the increase in their actual cost, but has restricted the increase in the ineligible charge. They have said they have chosen to partially subsidise this charge so as to continue to make the rent affordable, on the basis that their tenants are all getting full HB. I have explained that i believe that while they could choose to subsidise the overall charge for heating/lighting i wasn’t sure that they could choose just the ineligible part. Not sure if anyone has a view on this.
