if the care order and living with the claimant were mutually exclusive, so a care order being in place prevented the child as being treated with living with the parent, then there would be no need for the wording of the reg.
the regs states is NOT living with the customner AND is a looked after child
Also, i dont think a care order itself means the child is a looked after child
