Sorry Amanda, I misread the first post, I hadn’t appreciated that you ave a separate scheme for UC cases. It’s maybe a little more tricky that the non-UC scheme specifies, but the UC scheme doesn’t. Our scheme would treat UC claimants as working age, so it works OK – they’re all subsections of the same scheme, if you like.
True, you can’t use the maximum total liability as a limit. Hmm. I think you may be stuck with amending the scheme. Not sure if you would have to consult, as it would change the basis of the scheme to one which is potentially disadvantageous to some cases. ….I’m not being much help here….
You’ve a good argument for amending though – potentially a VT can find that the max CTS is the full un-apportioned liability.
