It depends whether he has the right to demand payment of some or all of the trust capital to him. It is more conventional for these trusts to be discretionary, in which case he has no right to anything and the money will only be used if and when the trustees at their discretion consider it appropriate. Otherwise there wouldn’t have been much point in the deceased leaving the money in trust at all – might as well have just left it to him.
