Reply To: Do LHA Rules apply or not?


Hi , we have a situation were a pensioner living in private rented accommodation currently paid HB under local reference rent , now has a new landlord who has increased the rent substantially citing LHA rates. Could this(a new landlord) and possibly a new tenancy agreement? ) be considered a trigger to move to LHA rate under HB , without the normal break in the claim , as this wouldn’t be appropriate as they are a pensioner, so 1 week break wouldn’t apply (not really the policy intention . Any ideas ?
