The current text in our scheme is as follows:
(e) the applicant’s applicable amount would include the support component or the work- related activity component on account of the other member having limited capability for work but for that other member being treated as not having limited capability for work by virtue of a determination made in accordance with the Employment and Support Allowance Regulations 2008 or the Employment and Support Allowance Regulations 2013
The CTR amendment regs contain different wording:
(d) in paragraph 25 (treatment of childcare charges), in sub-paragraph (10)(c) for
“applicant’s applicable amount would include the support component on account of the
other member having limited capability for work or the other member of the couple
would be” substitute “other member of the couple would be a member of the support
group or”.
I 'm confused and have been through amendments since 2013 and can't find any changes to this. Any idea how it should read?
