I had already considered that and the overpayment period is under 13 weeks. I was just trying to keep my example simple to address the questions I’m left facing. She definitely gifted it away on 16.12.08 and a large proportion came back at the end of Jan 09. Bank accounts seen etc.. She retrieved the money as she realised we would take it into account and used what came back to clear some of the benefits overpaid. Thanks anyway.
