Reply To: LHA, Rent Apportionment and maximum rent


I mentioned to the DWP that the example to which you refer illustrates the room allocation correctly, but is not correct as an example of their actual maximum rent (LHA).

As per Regulation 13D (6) the maximum rent is the lower of the applicable LHA or the cap rent plus £15.

Regulation 13D(12) defines the cap rent as the rent duly apportioned for mixed use accommodation, more than one liable person, and discretion to reduce the eligible rent.

So Andy is correct. In the example at 2.27, John and Alex would have a cap rent of £50 each (their respective halves of the joint liability) plus £15 if that was lower than the two-room rate of LHA.
