There is a lot of onus here on the claimant / true owner to prove a liability. The information initially supplied was false; so you could create an overpayment from 2011 and then ask the many questions to decide whether reg 104 can apply…underlying ent. My strong suspicion would be no….because the claim was a complete scam.
