It is been argued that reg 7(14) and (15) apply. However, in my opinion these have no bearing as he was not on temporary release. He was under HDC scheme which in my mind is not the same thing.
I would still treat him as convicted prisoner throughout the whole period, wheras it has also been argued that he should get HB as he was absent less than 13 weeks whilst in prison, and less than 13 weeks under HDC. Can anyone advise?
