The latest issue of Housing Benefit direct (issue no. 14) has a list of ‘frequently asked questions’ relating to Tax Credits, and that is one of them.
Their response is that being in receipt of the [b:021bbc7ee2]disability[/b:021bbc7ee2] element of Working Tax Credit [b:021bbc7ee2]does[/b:021bbc7ee2] give entitlement to a disability premium in HB / CTB, but in the majority of cases the person concerned will also be in receipt of another qualifying benefit eg: DLA.
Can’t point you at any regulations which confirm this though!
