I am pretty sure if this ended up before a tribunal judge and the mother explained the reasons for her setting up the tenancy in order for her daughter to have somewhere to live, the judge would find the daughter treated as liable. The arrangement is a merely a mechanism to get round the potential refusal by the letting agent of the daughter as a tenant. There would not have been any problem if the mother had acted as guarantor for the daughter on the tenancy which is how many people with poor credit records get around the problem.
