I don't think so, http://www.legislation.gov.uk/uksi/2013/380/regulation/6/made, the 6 month (In live service areas) only means there is no need for a new claim, they just revise the "nil" decision. So, as that's the case, they can't get a full earnings disregard albeit the UC claim is live there is no entitlement.
