The reg that Julian quotes is this:
“The Housing Benefit Regulations and Council Tax Benefit Regulations shall have effect, except where paragraph (2) applies, in relation to any person who has attained the qualifying age for state pension credit, subject to the modifications or amendments set out in this Part of these Regulations.”
My assumption is that it is supposed to be read like this:
“Except where paragraph (2) applies, in relation to any person who has attained the qualifying age for state pension credit, the Housing Benefit Regulations and Council Tax Benefit Regulations shall have effect subject to the modifications or amendments set out in this Part of these Regulations.”
In other words, these amendments have effect for people of Pension Credit age. That’s how I read it, but I haven’t seen bernie Mitton’s letter which might completely undermine what I’ve just written.
