    What is the legislation that says that where a person in receipt of HB is no longer entitled to it when they make a claim to UC?

    and reg 7 UC (Transitional Provisions) Regs 2014 appears to relate to when an HB TP would apply?

    It’s actually Reg 8, which contains the crucial detail that there is a two-week run-on.

    Reg 5 says you cannot get HB and UC at the same time (except for specified/TA), and kicks in when an existing UC claimant moves on to general needs – no run-on there

    Reg 7 says HB terminates when you shack up with a partner who was already on UC – no run-on there either

    Reg 8 applies when someone on HB makes a claim for UC (eg after being found fit for work, or when an IS claimant’s oldest child reaches 5). HB terminates two weeks after the date of the UC claim.

    Thanks Peter & Nick – suddenly asked by a Judge to explain it. Not been asked before and was suddenly stumped.
