Mixed age couples

    Hi all,

    Think I’m having a senior moment here. MAC couple in receipt of PCGC prior to May 2019 but not HB. Are they protected and can make a claim for HB?

    I think yes as long as PCGC has been continuous and they have remained part of the same couple since May 2019.

    Do you mean a new claim for HB? Have they moved to your area from anther Council area where they were getting HB?

    we have limited info at the moment, they haven’t actually made a claim yet. Support worker is just Just making enquiries on their behalf so we have asked them for further information. At the moment all we know is they’ve been claiming PCGC prior to May 2019 and they’re currently living with family in some capacity (not sure of they are tenants or not).

    If the older partner is on PC, and has been since May 2019, and they have been a couple since then, the older partner can make a new HB claim.

    Legal refs for this are Article 4 of the WRA 2012 No 31 Order (SI 2019/37) and Reg 6A(5) of the UC (Transitional Provisions) Regs 2014.

    The new HB claim must be made by the older partner.
