    Hi there

    I have a claim for Discretionary Council Tax Reduction. The person has no recourse to public funds so we cannot award Council Tax Support. Does anybody know if Discretionary Council Tax Reduction is counted as Public Funds. I have checked out the government website and read S115 of Immigration Act and cannot find that it is excluded – any thoughts welcome.

    It’s not public funds. The definition can be found in para 6 of the Immigration Rules here: https://www.gov.uk/guidance/immigration-rules/immigration-rules-introduction

    It refers to a CTR scheme made under s13A. The word “scheme” means the “scheme” in s13A(1)(a) and (2), which is separate from discretionary reductions under s13A(1)(c)
