Universal Credit and Capital

    We have a claimant where Penderels Trust are their corporate appointees as he is unable to deal with is own affairs. They have applied for HB (Supported Accommodation) and he is in receipt of Universal Credit but his capital has exceeded £16k through him not being able to spend his Universal Credit.

    We have been advised by Universal Credit that they are going to ignore the capital that has built up and continue to pay UC. Is this correct?

    I am not sure if that is correct but I have always been advised that we work in line with The DWP decision.

    All you can do is advise The DWP of the capital which you have done; if The DWP are going to ignore that and UC remains in pay, I see no reason why HB cannot be awarded.

    I would however ensure you save all evidence to your DIP system in case The DWP change their decision on the future.
