Paying LL but where to pay £15

    We have a claimant who meets our safeguard policy and HB is paid into the LL’s bank account.

    However, the claimant has not/will not provide proof of his bank account to allow us to pay him the £15 excess.

    We are Northgate users and only pay entitlement by BACS so would struggle to raise cheques etc.

    What are other users doing?

    I think you’ll have to pay him by cheque. What other choice do you have?

    This may be a bit controversial, but if the claimant doesn’t want the £15, why not use regs 13D(12) and 12(B)(6) to restrict the cap rent to £15 below his rent liability, then pay it all to the landlord? You could argue that its unreasonable to pay more than the rent liability if the claimant doesn’t actually want the excess…

    …. but is he saying he doesn’t want the excess? I read the original post to say he just won’t/can’t give his BACS details.

    I think the person perhaps doesn’t understand why we need his bank details. He meets our safeguard policy so must have difficulties which may go some way to explaining why he is ignoring us.

    I’m going to get one of our visiting offices to go out and explain to the claimant that he’ll be quids in if we get his bank account number.

    Unless the claimant is in arrears I don’t think you can pay the landlord the excess anyway.

    As for restricting the rent, doesn’t that fly in the face of the principle of getting claimants to take responsibility for managing their affairs, freedom of choice etc?

    It may be worth exploring the appointee option to whom the claimant’s excess can be paid (on their behalf). If there isn’t one they may prefer to have one appointed rather than giving their own details.

    If all fails I think you have to issue the payment by cheque.

    Martin’s right, there is nothing in the regs that says HB has to be paid by BACs….. I understand the Admin issues but that’s not the claimant’s problem….
