1 day gap in JSA – EPP??

    A claimant has been on JSA then IS for over 26 weeks, however there was a gap of 1 day in the award. Would you award the EPP even though there has been a break in entitlement?

    Harsh as it may be, I can’t see how an EP can be awarded. HBRs 72 & 73 are explicit: there must be both entitlement to AND payment of the qualifying benefit in question. In addition, the payment and entitlement must be continuous. If the gap is showing on CIS, is this by any chance an error? Was the clmt paid clerically for one day?

    NB: I’m assuming that JSA was income-based. Passporting versions and contributory versions of the same benefit can’t be mixed and matched.
