13 Week Protection from Rent Restriction

    Help

    We are currently going to give a pensioner a claim date of 52 weeks prior to his form being received.

    He received Guarantee Credit prior to selling his house and taking a private tenancy on.

    Therefore he could afford to pay his rent from capital.

    Please can someone confirm that he should receive a 13 week protection from a Rent restriction.

    I think he should have and this should be apply for the 1st 13 weeks of the claim. Not 13 weeks from the date we receive the form.

    Lisa, I agree with you that he should get 13 weeks protection for the first 13 weeks that you are going to allow HB. I assume that he really did pay his full rent from when he took on the tenancy.

    I am in agreement. Should be allowed 13 weeks at full rent prior to any restrictions being imposed
