We have quite a complicated case here.

Claim form has been received for CTB and HB.

Claimant and his partner run a Bed and breakfast that they rent. The property was actually advertised for rent as a B&B.

They have put a claim in for benefit as they receive no income from the business over the winter through lack of trade.

The rent is actually £800 per month.

The claimants household consists of himself, partner and 1 child.

Should this claim be paid at the £800 pcm for the 1st 13 weeks as he has not been paid HB in the past 52 weeks and at the time he accepted the tenancy they could meet the cost.

Yes, but with one proviso to bear in mind. Is the rent for residential purposes?

    Regards
