19 yr old EEA natiional refused IS but been here for 7 years

    Hello,

     

    some advice would be appreciated on this one please.

     

    We have an EEA national who is 19 years old. She has been here for 7 years living with her parents. She has now been made homeless and has a chukd of her own aged 1. DWP have refused her Income Support. Do we refuse her claim as she doesn;t have worker status or does the fact she's been here for 7 years (albeit as a minor for the most part) mean we can ignore that part?

    Are the parents still here, still working?

    Her father is here and working.

    Well no problem then, she is fine till 21, as long as 1 of the parents is in work. I wouldn’t worry with the I/S refusal, she would be entitled to JSA but that’s not what she claimed, or permanent residency, at this stage.
