26 WEEK DEFERRAL ON NON DEPS

    Can anyone give me the relevant Regs for the following situation please? Partner receives the higher rate care component of DLA. There is a non dep in the household. No deductions made because of the DLAC. Partner dies. Should the non dep deduction be deferred for 26 weeks or not? The regs seem to cover the circumstances of the non dep which means a deduction would apply from the change of circs, but this seems unfair.

    Can’t remember the reg off the top of my head – and I’m not looking for it as I’m going home in two mins 😀 😀
    BUT I seem to remember it applied in cases where a new non-dep moved in or a change in the non-deps circs, I’m afraid, not the claimant or partner. 😥

    I think Jon’s right. It started out as being a change in non-dep’s income only, then got changed so that any change in non-dep’s situation which caused a higher deduction counted, but I don’t think it went as far as changes to circs of claimant or partner.
