    Polish lone parent come over October 2005. Application for benefit October 2006. Is working but states had a gap in work 02.12.05 to 24.02.06.

    From the limited info I have received I think as the gap is over 30 days we cant pay claim.

    All advice welcome.

    As an A8 worker (assuming has registration card/certificate), clmt will be entitled to HB.

    The break in employment means that he/she has not established worker status, when there is no need to register. This will be obtained through 12 mts continuous employment – breaks of up to 30 days cumulaive allowed.

    If he is working now and signed up to the worker registration scheme there is no problem paying now.

    You could not backdate and pay for the period of the gap however.

    There is a registration certificate issued 06.05.05 job start date 21.03.05.

    So she must have been here earlier than the October 2005 I first indicated.

    Should I request current certificate ?

    Yes; it should state the current employer. The worker should make sure get a new one each time he changes job during the 12 month period (which will have started again 24/02/06)
