A8 national – claimant no longer working – partner is.

    Hi,

    Both customer and partner were originally working but the the claimant has ceased work. Registration document becomes invalid once employment ceases.

    Can either of the couple make a claim for HB?

    Assuming they are both European (EEA), if the partner is still working legally with the appropriate documentation, he / she may still have the right to reside.
    As such your current partner may be able to claim HB / CTB. 8)

    actually they are both from lithuania so are A8 workers – do you think this makes a difference?

    You only look at the claimant’s status.
    So if your partner became your claimant they are working on a low wage, presumably on BIA Worker registration Scheme, and should, all other things being ok, have no problem in claiming HB / CTB.
    The current claimant, though there is not full info here to be able to define, may not be entitled as may be classed as no longer economically active. 8)
