A8 taking a career break after maternity leave ends

    We have an A8 who went onto maternity leave in July 2010 in May 2011 she decided to take a career break for an indefinite period, she is still under a contract of employment with NHS (zero hours) – basically they seem to be keeping her job open for her.

    Does she retain her worker status whilst still under contract or has she really removed herself from the job market whilst taking this break?

    Any help would be appreciated.

    I wouldn’t say she has really removed herself from the job market but good question: is she still a “worker” or has she retained “worker” status?

    One thing I am sure of is that she is still an employee but she has decided not to work for an indefinite period voluntarily. Only way to have R2R is if you consider the fact that she is on unpaid leave.
