Absence

    Elderly gentleman finds out he has a 6 month old motherless baby in care of Social Service. he applies for custody, before custody is granted gentleman has to spend a minimum 16 weeks in a live in centre whislt he is assessed as to his ability to care for the baby. The customer is not under a court order, he just has to complete this course if he wishes to continue with his custody battle.

    Any thoughts would be gratefully received

    Just a thought…
    If social services (or whoever dealing with custody issues) made aware of HB implications, perhaps they could ‘tailor’ the programme for this chap so that he returns home for a brief period within the 16 weeks, thus stopping the “13 week clock”?

    Not familiar with the “live in” scheme but would have thought that he could/should return home for the odd evening during the 16 weeks.

    I can see why SS might want him to have an unbroken 16 weeks (he is about to have 16 unbroken years) but is it reasonable.

    As has been said I’m sure SS would agree to a return home for an evening or two during the period.

    Problem is after week 2 he is solely responsible for the baby at the unit – he will have to remain there and receive supervision. Therefore, cannot leave leave baby, and will exceed the 13 weeks.

    Tried to go about that angle but SS dont seem to be interested in playing the game.

    The footnote at end of Reg 7 states: “training course’ means [b:d3a7172d29]a course of [/b:d3a7172d29]training or [b:d3a7172d29]instruction[/b:d3a7172d29] [b:d3a7172d29]provided wholly or partly by or on behalf of [/b:d3a7172d29]or in pursuance of arrangements made with, or approved by or on behalf of, Scottish Enterprise, Highlands and Islands Enterprise, [b:d3a7172d29]a government department [/b:d3a7172d29]or the Secretary of State.

    8) up to 52 weeks then?! 🙂
