Absence from Home

    Clt (Iraqi national with unlimited leave to remain) goes back to Iraq for a holiday with her family during the summer hols.- She doesn’t tell us that she was going. Whilst there her ex-husbands family break into her families house and steal her passport and that of her kids (all school age).

    Due to the fact the place she is staying at is in a very remote area she can’t, as yet, get a new passport and visa to get back to the UK. He absence from home now exceeds 13 weeks. Any ideas how I can continue to pay? None of the other exceptions for absence over 13 weeks apply.

    You can’t pay from the point at which it became apparent that the absence would exceed 13 weeks.

    How long did they originally intend to be away for? If they were always planning to be away for more than 13 weeks HB would end from the week they left the UK.

    If they intended to return within 13 weeks, but the loss of their passports prevented that, I would stop HB from the week in which they lost their passports.

    (continued) Sorry, I can see you’re looking for a way to pay, but I don’t think you can do much for them in these circumstances.
