Absent landlord

    We have a case with a tenant in a 2 bed flat. The landlord is resident but is absent from the property for months on end.

    The claimant has confirmed that she has the run of the flat whilst the landlord isn’t there and there is no lock on the landlord’s bedroom door.

    I would be happy to award 1 bed LHA rate but can anyone just back me up?


    I’m thinking shared accomodation rate, but it would depend on a few things:
    What does it say on the tenancy agreement?
    What rooms does the claimant say she has exclusive use of?
    What is the landlord’s normal address? eg Does he live elsewhere and occasionally stay here, or does he live here and occasionally stay elsewhere?
