Admitted Late Appeals

    I have 2 late appeals that after short submissions to TTS and interlocutory hearings, the judge decidec to admit. The decision states why and asking for the appeals to be listed next available slots.

    Problem is there have not been full submissions sent for either of these appeals and as we were expecting a straight strike out (they are 5 years old!) the appealants have not received any paperwork. I have written to the TTS askinf if they want a full submission but I have not had a reply. Should I send one anyway?


    Yes I would. Otherwise you run the risk of an adjournment and more wasted time.


    As there is a right of appeal against an interlocutory decision, confirmed in LS v Lambeth you could go down that route.
