    In LHA guidance 3.69 it states that if a cofc is reported late the new maximum rent is based on the LHA applicable at the time of the change, not when change was notified. It also states the anniversary date will still be counted from the date the change occurred even if the notification was received late. Does this mean:-

    Non-dep moves out 10 May, Notified 10 Sept. LHA rate changes from 2 bedroom rate to 1 bedroom from Monday following 10th May using May LHA. Non dep stays on claim until date of notification. Anniversary date stays as May 12 months later? or

    LHA rate changes to 1 bedroom rate for May but not until date of notification. Therefore previous LHA rate used to date of notification, then May LHA rate used from date of notification. Anniversary date stays as May 12 months later.

    My understanding is that the non-dep would be ended on 10 Sep (date notified) and the claim would be reassessed from Sep using May’s LHA rate for one room. The anniversary date for the LHA would be 10 May the following year.
