Aide memoire from DWP 18/06/2003

    Can anyone shed any light on where the DWP have got their guidance from about the departmental error overpayment in example 3? It says that any overpayment arising from the date of change to the date we are paid up to should be departmental error, unless of course the claimant ‘unduly delays’ in which case we will get some claimant error. para 412 of the tax credit guide relates departmental error to mistakes made by IR and A7 of the HB guidance manual says the same. Have I missed something? And what is the interpreation of ‘unduly delays’? Where has this come form because the ‘aide memoire’ isn’t meant to be anything new.
