Appeal – can you help?

    Hi
    I am trying to find out whether a customer can still appeal a decision or whether it is too late.

    Claim was cancelled in January 2008 as customer didnt not respond to suspension.
    New claim received in June 2008.
    Backdate request made on 4 August 2008 for Jan to June – Refused.

    19 March 2009 – appeal received for the backdate for period Jan to June 08.

    Her circumstances are such that I would probably consider going back, however am I still allowed to given the time lapsed since the backdate was refused in August 2008?

    Any help appreciated – I do not have much to do with appeals as a rule.

    so……decision made 4 August 2008, appeal received 19 March 2009.

    In that case, you can still consider her appeal as long as she has grounds for failing to make that appeal within a calendar month of the decision.

    If she hasn’t already given them, you need to write to her asking for her grounds for her late appeal. The time limit for providing them is 14 days from the date of your letter.

    If she doesn’t provide them, you need to send the appeal to TS in any event. They will probably admit it as in time and you can revise your decision then.
