appeal time after reconsideration

    I’m sure this is a simple question but could someone please confirm for me what the time period is for someone to appeal following a reconsideration.

    A decision has been made and a reconsideration was requested. I was taught that the clock stops (for the 1 month in which to appeal the decision) from the date the reconsideraton was requested to the date the reconsideration took place. The claimant then has what time remains to appeal the decision.

    However I am writing an appeal (my first one when a reconsideration has been requested rather than an appeal) with this senario and when I read Schedule One of the Tribunal Procedure(First-tier Tribunal)(Social Entitlement Chamber) Rules 2008 it reads that the claimant has one month following the date the reconsideration took place.

    Could someone please confirm this?

    They do have a month after the reconsideration. I think you have been getting confused with the old rules when someone requested a statement of reasons and the clock stopped while it was supplied.
