appealable?

    Hi,

    if a late revision request is declined and the claimant makes another request for the decision to be reconsidered, 7 weeks after the decision was made, should I be advising the claimant that they dont have the right to make a second request under reg 5 of the DMA regs and advising them to appeal against the decision not to admit their original request?

    If so, the appeal is also going to be late, would i then have to go down the late appeal route? Ahhhh!

    An appeal against your decision not to admit the original request would be OOJ. However, they could make a late appeal against the original decision and that is what I would advise them that they should do, assuming of course that they are still within 13 months of teh original decision.
