Appeals system nearing collapse?

    Just wondered what other people’s experiences are at the moment. I am based in South Wales and currently DWP appeals for IS are taking well over a year to be dealt with and Tribunal Service are taking over four months to list hearings.

    Our own appeals are backlogged but are just about holding on.

    Just wondered if the situation with the DWP and TS is countrywide.

    Not sure re IS appeals here in the South West but about 4 months is probably on average for a HB appeal to be heard. Has the credit crunch added to the volume of ap peals or is it that more now seem to be accepted in the interests of natural justice ❓

    I think you will find that it is the DWP who are taking a year to forward them to the Tribunal! Talking to our district chairman he was in despair about the incompetence of the DWP and the fact that they are never represented. Judged by their standards LAs are a model of efficiency.

    Here in Essex I have just started attending hearings for appeals submitted at the beginning ofSeptember last year. I was then critised by one chair for the appeal taking so long to be dealt with!

    I’ve heard that TS in Cardiff are listing appeals they’ve recently received before older cases are looked at.

    We’ve got cases submitted last November still awaiting hearing whereas stuff we sent up last month has been listed already.

    The problem with IS appeals is alarming. We face the prospect of submitting cases within our time limits, only to find the claimant also has an outstanding IS type appeal which ideally should be linked. So we end up submitting our cases without knowing whether the IS decision will be overturned. Happy days 😡

    In September 2008 we got a SOR where the chair admitted the panel had made a mistake and we should ask them to set the decision aside.
    We did that straight way. the agreement to set aside finally arrived yesterday.

    Since the start of this year, every time we write and ask for an SOR we are just sent a 2nd copy of the original (usually 1 or 2 lines) decision.

    Something is rotten in the state of Denmark.
