Au pairs

    I currently have a claim form someone who is employing an au pair as this is cheaper than paying for more traditional child care.

    I can’t decide if the payments she makes are eligible to be allowed as child carepayments and wondered what anyone else thought?

    The payments are allowable if the relevant conditions are met. No different from any other childcare arrangement. DWP guidance is that au pairs should not normally be treated as non-deps.

    The problem though is that an au-pair is highly unlikely to meet any of the criteria in HB Reg 28(8) (i.e. they won’t be registered with OFSTED, on school premises, etc). So the childcare charges won’t be eligible.

    The DWP advice on au-pairs not being non-dependants is also dubious. They’re right for HB (HB Reg 3(2)(ii) prevents au-pairs being classed as non-deps). But in CTB there is no parallel provision and it seems that they do count as non-deps and, hence, a CTB deduction may apply.
