‘Backdate’ HB/CTB claim when Gtee Credit awarded

    Claim received in Feb 08 with excess capital. Cancelled Nil entitlement. Letter to Claimant advising would need to reclaim if/when Gtee Credit awarded. (Welfare advisor helping claimant to claim Attendance Allowance which would result in award of Gtee Credit.)
    ETD received 25/9/08 stating PCGC awarded from Jan 08.
    We sent new form in Oct 2008 but this wasn’t returned. We sent letter during CTB Pensioner take up campaign in Oct 09. After no response we visited to help complete a claim in Mar 2010. Maximun benefit was then awarded from 3 months prior to that time – Dec 09.
    A query has now arisen whether we should have reopened the claim received in Feb 2008 and awarded HB/CTB using PCGC award start dates. when we received the ETD in Sep 08.
    Any advice welcome.

    Well DMA regs allow a revision from feb 08. That’s the starting point. I would argue, IMHO, you could even say entitlement should commence in Jan 08, as it’s a 60+ claim.

    Absolutely agree with Kay.

    You should have done this in September 08 as a simple, routine revision.
