Backdating for More than 52 Weeks….

    Hi All,

    Is there anyone out there who can point me in the direction of any HB regs, (new 2006 or otherwise) that state Benefit can be backdated for longer than the usual 52 weeks. I have read about it somewhere but for the life of me cannot remember where or when.

    Any ideas??

    What exactly have you in mind? Ordinary backdating is no more than 52 weeks but I have an idea that you are refering to a retrospective award of a relevant benefit (EG DLA or AA). You should find what you’re looking for in the DAR regs 7 & 8. My understanding is Reg 7 (2)(i) and Reg 8 (14) will apply.
