Backdating – Good Cause Provisions

    Can anyone tell me where the ‘Good Cause Provisions’ are? They are referred to in para 2.129 of the Guidance Manual, but it is not the document shown at A2 – Annex A of the GM as this an extract from the AOG guidance. I would be very grateful if someone could let me know as I am putting together some backdating training notes.


    Look at the note at the beginning of Annex 2:

    Note: Although the Adjudication Officers’ Guide (AOG) is no longer
    current, the information in this annex, which is based on the AOG,
    provides a useful basis to establish whether good cause exists.

    The content of this is based on caselaw relating to good cause for backdating other social security benefits, which was superseded some years ago when the backdating provisions for everything but HB was changed.

    Because it is based on the “continuous good cause for a late claim” principle, the guidance given here is just as valid now for HB purposes as it was for other benefits.
