Backdating Pensioner claims

    We have a claim on Pension Credit Guaranteed that ended 27/03/05 income exceeds claimant reached 65. New claim in for HB/CTB 15/08/05 can this claim be backdated automatically to date previous claim ended or do backdating rules only apply to first claim for Pension Credits or HB/CTB. We have a difference of opinion and the regulations do not seem to be clear as to whether it applies to all subsequent claims.

    If you read Reg 72 BA it says in part 2 “”….the prescribed time limit for claiming Housing Benefit is as regards any day on which ……… the claimant is entitled to Housing Benefit, that day and the period of 12 months immediatly following it”.
    No mention of whether it doesn’t apply to repeat claims, so therefore it applies to all claims, as repeat claims after a period of non-entitlement don’t appear to me to be excluded. 8)
    Unless anyone knows of a commissioner’s decision to the contrary. 😉
