Bank balances and accuracy checks

    Hi.
    During an accuracy check it was found that an assessor didn’t update the balance of a customers bank account.
    The customer provided the balance stapled to the back of a rapid reclaim form but did not explicitly make any declaration that his capital was any lower than that used in his already running claim.
    Because the customers has other accounts, is there any mileage in saying that no error has occurred because his capital level can not be determinded with reference to one account alone i.e all accounts should be provided, as money may have been transferred?

    As the rapid reclaim form is used in connection with reclaiming JSA(IB) or IS, why are you worried about bank balances?

    If JSA(c) was put into payment, I don’t think you should have accepted the Rapid reclaim form.
    You may wish to ask him to complete a new form.
    I would have thought there is almost certainly going to be an overpayment which will be LA error – I cannot see any other classification. I would think it would be very difficult if not impossible to argue that the claimant should have known about the overpayment so it may well be that you would have to make this not recoverable. 8)

    There is no overpayment associated with this claim. It is purely a question of accurate processing.

    There may be an overpayment as I do not believe that you can use a rapid reclaim form to process an award of HB / CTB where IS or JSA(IB) is not in payment 8)
    Interested in other people’s thoughts on this one.

    Isn’t it just up to the LA as to what they choose to accept as a claim form?

    HBR 83. —(1) Subject to paragraph (4A), every claim shall be in writing and made on a properly completed form approved for the purpose by the relevant authority or in such written form as the relevant authority may accept as sufficient in the circumstances of any particular case or class of cases having regard to the sufficiency of the written information and evidence.
