We have a very similiar case to this. Clmt has lodged an appeal against decision in May 06 that he was OP for period July 05 to May 06.
He was made bankrupt in Jan 06.
He is no longer in receipt of HB/CTB but does get SRP.
He states we can’t touch him due to bankruptcy but I think we can look to recover from SRP.
Also, CTB overpayment was passed over the Ctax account in May 06. They would appear to have written off due to the bankruptcy for fin year 05/06……..this has complicated matters more!
Can anyone shed any light on this?
